Re: [lgbt-india] Centre to clarify stand on gay sex next week

The classic 105 page judgement of the Delhi High Court may have liberated us homosexuals, transexuals and every kind of sexuality, but what the government is now faced with is a rising backlash that seems to be building up by the day.
The UNI report jumps to a conclusion that is not very comfortable in that it thinks we have had our way and liberty and life are at hand.
However, what matters is how the Supreme Court is going to show homophobes and assorted lunatic fringe elements the door. What people like me are slogging at is why must a law, that was seldom used escept for intimidation and oppressing millions of human beings, must go.
Are even simple rights like the right to health and well being human eights? Is it important that in an unequal and unjust society where farmers are committing suicide, dalits burnt for no reason at all except that they are dalits, minorities of every hue and colour ghettoised or driven out of their homes and hearths, some modicum of justice is seen to be done that brings us all to the table of democratic thinking and just 'being'?
That's what is going to matter when the Supreme Court deliberates on the issue..
The Delhi High Court judgment is being studied by sane men everywhere as a masterly crafted document on human rights. It comes at a crucial time when the United Nations debates what exactly are human rights even as the Organisation of Islamic Countries (OIC) has ridiculed the whole concept of sexuality as some "vague right" outside the purview of the UN Charter on Human Rights.
What the Supreme Court of india is now sitting on is a bubbling volcano. One way or the other, large segments of our people will fight and procure their freedom, come what may. The choice is whether this can be done wisely through the houses where justice is supposed to be dispensed or to seize it violently as is happening in the jungles of Chattisgarh and Jharkhand.
In a land where both the Right and the Left have withered away, it is something the citizenry of this ancient land must decide for itself. That is the real test of this impending ruling which the indian Supreme Court poses for us all..
It is not prayers but powerful arguments in the fight for justice that will prevail.
And prevail we will..
