With due respect to the sentiments expressed, refusing a stay on an order is not exactly upholding a judgement. In fact it does not mean anything other than the fact that the judges are anywhere near deciding on the issue. So headlines should be crafted a little more carefully, as it can convey a totally different meaning than what is really happening.

 

I urge caution, while writing such headlines..

Apex court upholds Delhi HC judgment on gay sex

Supreme Court on Monday refused to pass interim order to stay the Delhi High Court judgment legalizing gay sex among consenting adults.

The apex court upheld the ruling after hearing a plea filed by astrologer Suresh Kumar Kaushal against the Delhi High Court's verdict.

The Government on Monday sought eight weeks to come up with a definite stand on Sec 377. On July 9, a two-judge bench of the apex court comprising Chief Justice K G Balkrishnan and Justice P Sathasivam had issued notice to the Union Government, to explain its stand on a petition challenging the Delhi High Court's ruling to legalize gay sex among consenting adults.

The bench heard the opinions of all the parties concerned before giving the interim order in this matter.

Except the Communist Party of India-Marxist (CPM), no political party has made its stand clear on the Delhi High Court's ruling to quash Section 377 of the Indian Penal Code (IPC).
